Norma Terms of service

This document establishes the Terms and Conditions (“Terms”)under which Hypermind, offers its clients ("Users") access to the Norma application (“Norma”) which can be accessed from any electronic device connected to the Internet.

Norma is owned and managed by Hypermind, registered in Bucharest,Romania.

By using the Norma as a User, you agree that the company ("Customer") you represent is aware of these terms as aCustomer. If you do not accept these Terms, you will not be able to use the Norma Application and Services.

These Terms constitute a binding and enforceable legal contract between Hypermind („Norma”) and a User (defined below) or any end user of the Services (collectively, „you”).

If you represent an entity, organization, or any other legal person, you confirm and represent that you have the necessary power and authority to bind such entity, organization, or legal person to these Terms.

By using the Services, you agree that you have read, understood, and are bound by these Terms, and that you comply with the requirements listed herein. If you do not agree to all of these Terms or comply with the requirements herein, please do not access Norma or use the Services from Norma.

Customer ensures that its Users use Norma in accordance with these Terms.

We reserve the right at any time in the future to amend these Terms in order to reflect any regulatory updates or changes in our commercial and marketing policy. Upon return to our website, please check the date of the last update and any amendments.

Updated versions of the Terms will be published on the Norma website and will become effective upon publication. Users are encouraged to review these Terms periodically.

To protect your Norma Account, you need to keep your password confidential. You bear the overall responsibility for the activity conducted within or through the Norma Account. Do not try to reuse the Norma Account password for other third-party applications. If you find out about any unauthorized use of your Norma password or Account, we kindly ask you to change your access data and notify us this issue by email as soon as possible.

1. Access and Use of the Application and Services

The application is exclusively available to employees of companies that have subscribed to Norma. To access the application, users must be registered and authorized by an administrator of the Customer.

Access to Norma is role-based, with different permissions granted depending on the user’s role (e.g., employee, HR manager, recruiter). Each user may have only one account. Accounts are created and managed by the Customer’s administrators. Only administrators of the respective Customer may create accounts.

Norma will be periodically maintained and updated to add new functionality or strengthen security systems.

Hypermind have the obligation to provide the Customer with all the Services according to the contract concluded between the two parties and ensures that the Services will be provided at a high level of quality and competence, according to reasonable standards practiced in the industry and comparable to other experienced providers of similar services.

The Services may include certain communications from Hypermind, such as service announcements, administrative messages and other information, collectively called transactional emails. You understand that these communications shall be considered part of using the Services. As part of our policy to provide you total privacy, we also provide you the option of opting out from receiving certain information from us. However, you will not be able to opt-out from receiving service announcements and administrative messages, as long as you are using our Services.

You are responsible for obtaining access to the Internet and the equipment necessary to use the Services. Some of our Services are available on mobile devices.

In order to use the Services, it is necessary to have an account in Norma.

Norma Account can be created by an administrator designated by the Customer or by an administrator designated by an authorized distributor. If you use a Norma Account created by an administrator designated by an authorized distributor, different or additional Terms and Conditions may be applied and the respective administrator may be entitled to access and disable your account. The Customer has the right to add in the Norma several users with various access rights – fully or partially – in the account and, moreover, it can delegate its attributions to one or several users.

Norma may be accessed and used exclusively via the online platform from Customer’s Norma instance, by acquiring anon-exclusive annual user license and based on an user account that can be accessed by a username and password.

We will ensure the efficiency and uninterrupted availability of the service throughout the duration of the Contract, data synchronization on secure servers, as well as technical assistance for theClient's representatives.

For the avoidance of doubt, our obligations are limited only to providing the Services and do not in any way include acting on behalf of the Customer.

2. Registration and Users

To use Norma, users must first have an account. The registrations can be done through an invitation sent by CustomerHR administrators or managers.

The invitation is sent from the Application in the form of an e-mail through which the newUser can confirm his registration.

Users will need to use their email address during the registration process. Only Customer HR administrators or managers may create accounts.

The creation, deactivation, and deletion of user accounts can only be performed by CustomerHR administrators or managers.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities under their account. Passwords must be kept secure.

The Customer must immediately notify Hypermind if it has reason to believe that there has been unauthorized use or access to Customer's login credentials and/orCustomer's account in the Application. The Customer shall be solely responsible and liable for any misuse and/or violation of these Terms resulting from the use of Customer's accounts to access the Services and/or Application

An account is unique and can only be used by the User for whom it was created. 

Demo Account

Before signing the Contract, we may provide access to use a Demo account in Norma.

The Customer must keep the confidentiality of the access data for the Demo account. Customer shall immediately notify us upon learning that the Demo account has been distributed or transferred to a third party.

Customer agrees not to access or use (nor allow others to access or use) the Demo account for a purpose other than evaluating the product.

3. Norma Subscription

Access to Norma is based on a subscription paid by the Customer. Payment of the subscription, including its related taxes, can be made by bank transfer, based on an invoice.

After the agreed deadline for the payment of an invoice has expired, we reserves the right to temporarily restrict access to the Application until the overdue payment is made. During the restriction period, Norma will continue to store the Customer's data unchanged until access is restored, or the Contract is terminated, as applicable.

4. Suspension of Access

If the Customer fails to pay the subscription fee for the application, access to Norma may be suspended or terminated after a 30-day notice period. All data related to the Customer will be deleted upon termination.

In the event of termination, the Customer will have a reasonable time period during which may export a copy of the data stored in the Application before all the data will be deleted permanently from the Application’s servers.

5. Privacy and Data Protection

Norma adheres to the General Data ProtectionRegulation (GDPR) for the processing of personal data. All personal information, including employee records and leave data, is handled with the utmost care and security

All data is stored and transmitted securely, with measures in place to protect against unauthorized access, disclosure, or modification.

Users can request access to, correction of, or deletion of their personal data through their CustomerHR administrators or managers.

6. Intellectual Property

Norma and all associated intellectual property rights, including software code, trademarks, logos, and content, are owned exclusively by Hypermind

Users are prohibited from copying, modifying, distributing, or selling the application or any part thereof without explicit permission from Hypermind.

7. Obligations

Hypermind will use the information made available by the Customer through the use of Norma only for the purposes related to the contract concluded between the two parties.

We take all necessary technical and organizational measures to protect the confidentiality and security of the Customer's information and stored data.

Hypermind will promptly notify the Customer if it becomes aware of any suspected violation of the Terms.

The Customer ensures that the data stored in Norma (including any texts, images, videos, audio, files, links to external websites, etc.):

a.    Complies with all applicable laws and regulations;

b.    Does not infringe any intellectual property or other proprietary rights of any third party;

c.    Is not offensive, illegal, inappropriate;

d.    Does not promote racism, hatred or physical harm of any kind against any group or individual;

e.    Does not promote any abusive, threatening, obscene or defamatory behavior;

f.     Does not promote any illegal activity;

g.    Does not invade or violate anyone's right to privacy;

h.    Does not create computer viruses or implement any form of software that affects the Application in any way;

The customer undertakes:

a.    Not to post content that do not correspond to the actual employment conditions;

b.    Not to post Jobs for the purpose of collecting Candidates for any reason other than legitimate employment;

c.    Not to post content on behalf of the Customer without its knowledge and consent;

d.    Not to solicit payments from Users or Candidates;

e.    Not to send unsolicited messages or spam to Users or Candidates.

The Customer has no right to resell the Services to any third party for any reason without express written approval from Hypermind.

Customer acknowledges and agrees that in the event of any dispute between the Customer and a Candidate arising out of the Customer's use of the Services, the Customer agrees that Hypermind is not responsible for any loss or damage suffered and the Customer releases Hypermind from all liability in connection with any dispute.

The Customer acknowledges and agrees that Hypermind does not verify the content, accuracy, correctness, completeness of the information or personal data stored by theCustomer in the Application. The Customer warrants that it has the right to collect and store personal data and is solely responsible for its use in accordance with the law.

Customer will promptly notify Hypermind if it becomes aware of any suspected violation of the Terms.

8. Third-Party Services

Norma is hosted in the cloud with a guaranteed uptime of 99.98%. However, temporary interruptions may occur due to external factors related to cloud hosting services.

If the application integrates with third-party services, the terms of those third-party services will apply. 

9. Limitation of Liability

Norma is provided "as is" without any warranties. Hypermind does not guarantee that the application will be error-free or uninterrupted. To the fullest extent permitted by law, Hypermind is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the application, including data loss, system interruptions, or any other damages caused by errors or defects in the application. 

10. Governing Law and Dispute Resolution

These Terms ofUse are governed by the laws of Romania.

Any disputes arising from these Terms will be resolved amicably between the parties. If an amicable resolution is not reached, disputes will be submitted to the competent courts in Romania.
